The Minimum Wages Act, of 1948 (the “Act”) is an Act of the Parliament of India enacted to ensure that all workers in India receive a minimum wage, regardless of the nature of their employment. The Act was enacted to provide a floor wage to protect the workers from exploitation and to ensure that they receive a decent wage. The Act applies to all employees in all industries and occupations, except a few such as agricultural workers, workers employed in the railways, air transport services, and certain other industries. The Act also applies to employees of contractors and subcontractors, provided they are employed in an industry or occupation to which the Act applies. The Act provides for the fixation of minimum wages by the appropriate government in each state. The appropriate government is responsible for deciding the minimum wage rate for scheduled employment in its state, after taking into account the minimum living standards of workers in the state, the cost of living index, the skill and experience of the workers, and other relevant factors. The Act requires the appropriate government to conduct periodical reviews of the minimum wages and to revise them at least once every five years. The government is also required to appoint committees and authorities for the enforcement of the provisions of the Act.
