TDS (Tax Deducted at Source) is to be deducted from rent paid to NRIs. The tenant is responsible for deducting TDS at the applicable rate, which is currently 30%. The tenant should deduct TDS and deposit it to the government account by the 7th of the following month and file TDS returns with the income tax department. Also, according to Section 197 of the Income-tax Act, 1961, the income tax assessing officer has to be satisfied that the total income of the recipient of such income justifies the deduction of income tax at any lower rate, or no deduction of income tax, as per the respective case.
