The Madras High Court on Thursday quashed the notification issued by the Tamil Nadu government in August 2018 banning the sale of gutkha in the state. The court ruled that the notification was arbitrary and unconstitutional. It held that the notification was in violation of Articles 14, 19 (1) (g), and 300-A of the Constitution of India and was issued without issuing any show cause notice to the license holders. The court also said that the government had not taken into consideration the rights of individuals, such as the right to livelihood, that were affected by the notification. The court directed the authorities to cancel the notifications and restore the licenses of gutkha retailers that had been canceled. It also directed the state government to pay compensation to the retailers and other persons affected by the notification.
