Yes, the Madras High Court has ruled that only Family Courts can issue Khula divorce certificates to Muslim women. The court said that while the dissolution of marriage is a matter of civil law, the process of obtaining a divorce certificate is a matter of procedural law. Therefore, it should be handled by the Family Court. The court also noted that the Family Court must ensure that the woman is not coerced into signing any documents. In addition, it must ensure that all the requirements of the Muslim Personal Law (Shariat) are met. It is open for a Muslim woman to exercise her inalienable right to dissolve the marriage by 'Khula' (divorce proceeding initiated by the wife) by approaching a family court and not private bodies such as a Shariat Council, the Madras High Court has ruled.
