The Dowry Prevention Act was enacted in 1961 to eradicate the practice of dowry. Both giving and receiving dowry is prohibited by this act. This Act is amended from time to time. Following the Dowry Prevention Amendment Act, of 1984, the Dowry Prevention maintenance of List of Gift Items of Groom and Bride Rules was framed in 1986 to carry out the objectives of this Act. The Act defines dowry as any property or valuables given or agreed to be given, directly or indirectly, by one party to a marriage to the other party or to either parent of either party. The punishment for paying or procuring dowry or complicity in giving and procuring dowry is imprisonment for a term not less than 5 years with a fine which may extend to Rs.15000 or the value of the dowry, whichever is higher. Directly or indirectly soliciting dowry from parents, or other relatives or guardians of the bride or groom is an offense punishable with imprisonment for a term not less than 6 months which may extend to 2 years with a fine which may extend to 10000 rupees. Favors offered by an advertisement for the marriage of son or daughter or any relative, share in property or money or both or share in the business or otherwise, is an offense punishable with imprisonment for a term not less than 6 months which may extend to 5 years with fine which may extend to 15000 rupees. Any agreement to give and buy dowry is void. A list of gifts in the form of an affidavit, notarized and signed by a security officer or dowry prevention officer, should be kept by both parties. Failure to do so will result in severe punishment for not only the bride and groom but also their parents, including imprisonment for up to three years.
