Dowry is a social practice in which the bride's family gives gifts, money, or property to the groom and his family as a condition of marriage. The Dowry Prohibition Act, 1961, was enacted in India to curb the menace of dowry and dowry-related harassment. The act defines dowry as any property or valuable security given or agreed to be given either directly or indirectly by the bride's family to the groom or his family before, during, or after the marriage. The key provisions of the Dowry Prohibition Act, 1961, include: Prohibition of giving or taking dowry: The act prohibits both the giving and receiving of dowry. Any person who gives, takes, or abets the giving or taking of dowry can be punished under the law. Penalties for demanding dowry: If the groom or his family demands dowry directly or indirectly from the bride's family, they can face imprisonment for a term not less than 5 years and with a fine of at least Rs. 15, 000 or the amount of the dowry, whichever is higher. Penalties for giving or taking dowry: If any person gives or takes dowry, they can be punished with imprisonment for a term not exceeding 6 months or with a fine of up to Rs. 5, 000 or both. Protection to the bride: The act provides legal protection to the bride in case she is harassed for dowry by her husband or in-laws. Any act of cruelty towards the wife related to dowry demands can result in imprisonment for a term not less than 3 years.
