In India, the practice of child marriage was first legally prohibited in 1929 through the Child Marriage Restraint Act, of 1929. As per the 1929 Act, marriage of girls below the age of 14 years and boys below the age of 18 years was prohibited. Only a contracting party to a marriage who was a child at the time of the marriage can file a petition in the District Court to annul the child marriage by way of a writ of annulment. If the petitioner is a minor at the time of filing the petition, the petition may be filed with the Child Marriage Prevention Officer by his guardian or his representative. A petition under this section may be filed at any time, but before the child petitioner attains the majority of two years. A male above 18 years of age who enters into a contract of child marriage shall be punished with rigorous imprisonment which may extend to two years, or with a fine which may extend to one lakh rupees, or with both. Any person who performs conducts, directs, or is an accomplice in any child marriage shall be liable to imprisonment for a term which may extend to two years and to a fine which may extend to one lakh rupees. If he fails to prove reasons why he believes that the marriage is not a child marriage, it will be considered for another investigation.
